Vendor Terms and Conditions
Welcome to Atricare.co.ke! These Terms and Conditions outline the rules and regulations for vendors using our marketplace to sell products or services. By registering as a vendor, you agree to comply with and be bound by the following terms. Please read them carefully.
1. Eligibility to Become a Vendor
1.1. You must be at least 18 years old and have the legal capacity to enter into a binding agreement.
1.2. Your business must comply with all applicable laws, including registration and licensing requirements.
1.3. Atricare reserves the right to approve or reject vendor applications at its sole discretion.
2. Vendor Responsibilities
2.1. Vendors are responsible for ensuring that all products listed on Atricare:
- Are accurately described with correct images, prices, and details.
- Comply with applicable laws, regulations, and marketplace policies.
- Are not counterfeit, illegal, or restricted.
2.2. Vendors must fulfill orders in a timely manner and ensure customers receive quality products.
2.3. Vendors are required to manage their shop, inventory, and pricing directly through the Atricare vendor portal.
2.4. Vendors must provide accurate and up-to-date contact details, including email and phone number, for communication.
2.5. Any customer complaints, disputes, or returns must be handled promptly and professionally by the vendor.
3. Payments and Fees
3.1. Atricare will process payments on behalf of vendors. Payments will be settled based on the agreed payment schedule and after deducting applicable fees or commissions.
3.2. Vendors are responsible for all taxes applicable to their business, including VAT, income tax, or any other statutory requirements.
3.3. Atricare reserves the right to withhold payments in cases of unresolved disputes or violations of these terms.
4. Prohibited Items
4.1. Vendors are strictly prohibited from selling the following on Atricare:
- Illegal or counterfeit products.
- Hazardous materials or substances without proper certification.
- Pornographic or offensive content.
- Any other products deemed inappropriate by Atricare.
4.2. Atricare reserves the right to remove listings that violate these guidelines without notice.
5. Intellectual Property
5.1. Vendors must ensure they have the legal right to sell the products they list on Atricare, including trademarks, copyrights, and other intellectual property rights.
5.2. Atricare shall not be held liable for any claims of intellectual property infringement arising from vendor activities.
6. Termination of Vendor Account
6.1. Atricare reserves the right to terminate or suspend a vendor’s account for:
- Violation of these Terms and Conditions.
- Fraudulent activities or misconduct.
- Poor performance or customer service.
6.2. Vendors may also request the closure of their account by contacting Atricare support.
7. Limitation of Liability
7.1. Atricare is not liable for any losses, damages, or liabilities arising from:
- The use of the marketplace by vendors.
- Disputes between vendors and customers.
- Technical issues or downtime of the platform.
7.2. Vendors agree to indemnify Atricare against any claims, damages, or liabilities arising from their activities on the platform.
8. Dispute Resolution
8.1. Any disputes between vendors and Atricare shall be resolved through good faith negotiations.
8.2. If a resolution cannot be reached, disputes will be referred to arbitration in accordance with the laws of Kenya.
9. Confidentiality
9.1. Vendors must keep any sensitive information about Atricare’s platform, processes, or customers confidential.
9.2. Misuse of confidential information may result in legal action.
